The Workplace Relations Branch is responsible for the KY Employee Mediation Program (KEMP) and the Workplace Resolutions Group. KEMP deals with issues primarily between two people (equal co-workers or employee and supervisor), while Workplace Resolutions includes an entire workgroup. Both programs are available to Executive Branch employees.
Mediation Mediation provides an opportunity for employees to solve problems with co-workers. A trained mediator meets with the people in conflict and helps them reach their own solution to their problems. The mediator does not take sides or make any decisions. Mediation is a free service for all Executive Branch employees. Either an employee or a supervisor may request mediation.
When to use Mediation Any Executive Branch employee with status may request mediation. However, it is a voluntary process and neither party can be forced to participate. Mediation can be used for personality conflicts, communication issues, ADA, FMLA, suspensions, and the workplace environment. Any grievable issue can be mediated. Mediation provides an opportunity to openly discuss problems. In most mediation cases, both parties say that they are satisfied with the outcome and that their situation has improved. Mediation promotes a win/win outcome.
Mediation Process Complete the “Request for Mediation” form and submit it to the KEMP manager, or call (502)564-5974. You may suggest mediation to the other party, or the program manager can make contact with the other party to inquire about mediation. If agreed upon, the program manager will offer possible dates for mediation. After a date is established, a confirmation letter is sent to the participants.
Mediation can help to resolve problems before they escalate. The process is confidential and requires all participants to sign a confidentiality agreement. Information about the mediation discussion will not be shared with anyone, including the supervisor, if the supervisor is not a participant. A mediator will not be assigned to mediate a case in their own agency.
